Notice is hereby given that on May 16, 2024 at 11:00 o’clock A.M., at www.publicsurplus.com Millard County Auditor will offer for sale at public auction and sell to the highest bidder for cash, under the provisions of Section 59-2-1351.1, the real property described on the enclosed Delinquent Tax Billing which located in the county and now delinquent and subject to tax sale.  A bid for less than the total amount of taxes, interest, penalty, and administrative costs which are a charge upon such real estate will not be accepted.

Notice is hereby given that on the 16th day of May, 2024, at 11:00 o’clock A.M., at www.publicsurplus.com. I will offer for sale at public auction and sell to the highest bidder for cash, pursuant to the provisions of Section 59-2-1351.1, the following described real property situated in said county and now delinquent and subject to tax sale. A bid for less than the total amount of taxes, interest, penalty, and administrative costs, which are a charge upon such real estate will not be accepted. 

Be aware that Millard County has established an Ordinance relative to Delinquent Real Property Tax Sales in accordance with Utah Code which is available for review.  Included in this ordinance is the requirement for all sales to be approved by the Board of County Commissioners.  

Millard County makes no warranty either expressed or implied regarding the condition or status of the title of any of the subject property.  The tax deed which will be issued conveys only the interest of the county which has been acquired by nature of the non-payment of the taxes assessed.  The title to the property should have been checked with the records in the Millard County Recorder’s Office by yourself or someone competent in that area.

In accordance with Utah Code Section 59-2-1351.5, “Any sale funds which are in excess of the amount required to satisfy the delinquent taxes, penalties, interest, and administrative costs of the delinquent property shall be treated as unclaimed property under Title 67, Chapter 4a, Unclaimed Property Act.” 

Parcels with limited bidding under Millard County Ordinance 3-3-7 meet criteria for limited bidding that have been determined not to be an economically viable unit of property, other than a preferential interest based upon consideration such as size, shape, access, zoning, or other factors including creating a nuisance or cloud upon an existing interest or if no interest exists, priority is given to abutting property owners. 

Research and Inspect Thoroughly Prior to Bidding
Prospective purchasers are urged to examine the location and desirability of the properties available to their own satisfaction prior to the sale. The County Auditor’s Office and Millard County makes no representation of warranty, nor any guarantee of warranty, either expressed or implied, relative to the usability, location, property lines, topography, physical condition, presence or absence of tenants, address, or fitness for any use or purpose. All properties are offered for sale on a “where is” and “as is” basis without any representation or warranty, expressed or implied. It is the responsibility of the purchaser to do their own research as to whether the property may be subject to liens, encumbrances, or restrictions and whether the property is suitable for their intended use. The properties may not be buildable lots. Millard County are not responsible for surveying, identifying, or locating property boundaries for buyers. Millard County makes no guarantee, expressed or implied, relative to the title, location, or condition of the properties for sale, which include whether a parcel is contaminated with hazardous, toxic, or contamination of any kind from any source, or whether parcels are subject to restrictions based on sensitive areas ordinances, applicable land use laws, or regulations. Bidders are further advised that certain properties may be subject to easements or use restrictions set forth in Covenants, Rights and Restrictions of certain Plats, as well as in zoning and other land use controls. Certain parcels may be designated as “Open Areas”, “Common Space”, “Common Areas”, “Drainage”, “Private Roadway”, or other similar designations, and are subject to restrictions, which may include, but not limited to, prohibitions on placing improvements on such parcels. It is the buyer’s responsibility to make a determination whether the property is restricted in any manner.

Recorded easements are not extinguished by a tax sale. Photographs and maps including approximate lot lines (if attached) of an asset are for general representation purposes only. Millard County will not assume any liability for alleged loss or damages which may result from the purchase of property relied upon via photograph or map Millard County are not responsible for identifying or locating for prospective buyers properties that are being auctioned.

NOTE: Physical Address or Situs address:
Millard County does not assign a situs address unless the property has an improvement. Therefore, parcels with land only do not have a situs address and we are not able to provide one. Again, it is the bidders responsibility to know the geographical location and all aspects of what they are buying.

Minimum Bids
Bidders may submit their credit card information once the bidding opens. Cards accepted are VISA, MasterCard and Discover. If you have enough credit on your card for the bid deposit (see updated list for bid deposit amounts) you should not have any issues placing a bid.

The minimum bid charge will be held on your credit card when you place your first bid and will be released if you are the unsuccessful bidder. Once the winner bidder sends the wire transfer for the total amount of the winning bid, the minimum bid charge on hold will be released from the credit card.

AGAIN, before you bid on a parcel of property be sure you know what it is, where it is, and the physical aspects of the land, accessibility and the availability or validity of water rights, liens, or any other interests. You are legally responsible for the bid price.  All sales are final.
